Introduction of Consular Legalization

1. Brief Introduction

In line with the Measures for Consular Legalization, the consular legalization mentioned in the Measures refers to the practice of confirming the authenticity of the last seal or signature on the foreign-related notarial deeds and other certificates issued in China or relevant documents issued by other countries, performed by consular legalization agencies upon the application of natural persons, legal persons or other organizations. The purpose of consular Legalization is to ensure that notarial deeds issued in one country can be acknowledged by relevant authorities in another country, and the deeds can have its due legal effect, which shall not be affected by doubts on the authenticity of the seal or signature on the deeds.

Chinese embassy in Myanmar can authenticate notarial deeds and other documents issued by relevant authorities of Myanmar for use in China.

2. Categories & Procedures

2.1The documents for legalization have 2 categories:

2.1.1 Civil document: such as I.D. card, certificate of birth, certificate of marriage, statement, etc.

2.1.2 Commercial document: such as certificate of company registration, shareholder list, etc.

2.2 Procedures: the document shall be first notarized by Myanmar notary authority, then delivered to Consular and Legal Affairs Department of Ministry of Foreign Affairs of Myanmar for legalization before being delivered to the Chinese embassy for legalization.

3. Documents Required

The following documents shall be submitted when applying for consular legalization:

3.1 A truthfully, fully and correctly filled Application Form of Consular Legalization;

3.2 The original document for legalization with a photocopy;

3.3 Original I.D. Card for Myanmar citizen with a photocopy. For non-Myanmar citizen, original passport and photocopies of pages with personal information, Myanmar visa and the immigration's stamp of last entry.

3.4 For legalization of Commercial document, a photocopy of I.D. Card of the company's legal representative and the document proving the representative's legal status.

3.5 If the applicant or company entrusts someone else to submit document, a letter of authorization and the I.D. Card of the entrustee are required.

3.6 Other materials required by the consular officer.

4. Particulars for Attention

4.1 Document should be true and comply with the laws of China and code of social morality.

4.2 Document fails to meet the format standards or is found forged, counterfeited or altered will not be accepted;

4.3 Document contains more than one page, it shall be bound as a volume by applying sealing wax, paging seal or steel seal to avoid any substitution.

4.4 The single status affidavit used for marriage registration in China is valid for only 6months from the date of issuance. Document for adoption affairs in China, such as statement of marriage, health status, proof of finance, income, no criminal record, can only be authenticated if the period between the notarized date and the adoption registration date (excluding the processing time taken by China Center for Adoption Affairs) does not exceed 6 months.

4.5 If the content of a legalized document is changed or substituted, the consular legalization certificate will become invalid. If the applicant or another individual or organization has forged or altered the consular legalization certificates, he/she or it shall undertake corresponding legal liabilities.

5.Processing Time and List of Fees

5.1 Document with legalization is collectable on the fourth working day after submission. Legalization Fee for Civil document is $22, for Commercial document is $44;

5.2 Documents failed to be collected over 3 months will be cleared up.
